Is it legal to work those long ours on Black Friday? I hear some employees raising issues about this being allowed to leave early.Howard Dean for America '08

Doesn't matter, if you don't knuckle up you're fired. This is non-contractual employment, they can fire you for anything non-discriminatory.

It isn't legal to force their employees to work all day like that. However most are willing to do so because it is the day that you will make a huge load of cash if you are willing to take it. That's why most of the employee's don't complain. Twelve hours I can do, but over that and you are going to have a lot of ticked off tired grumpy employees. Instead of the whopping two half hour breaks they should design their schedules so that you get like a two hour lunch throughout the day. Much better on the employees.:face-plain:

Depends on where you live. Here in Arizona it is completely legal. Im quite sure its legal in California too. They aren't even required to give you breaks in Arizona. California I believe breaks are mandatory and most companies with stores in places that require breaks spread their break policy chain wide to keep things simple. You CAN get fired for not working something like Black Friday but you can also file for unemployment on their ass.Superhero!

I wouldn't exactly ask what is legal...I would ask if you requested the time off ahead of time and if they are making you work over your schedule. If you did either of these, there is no store policy that would make it acceptable for them to fire you. If they do fire you, bring it to the CA labor board if that is where you live.

If you read this earlier completely throw out what ever i said. I got my schedule and they scheduled me for 39hrs, 19hrs over my agreement and 7hrs over part time. I'm going in tomorrow to see if there's an explanation for this shattering of previous agreements on work hours (better be in writing "we can completely change you're schedule, just because it's the holiday season and part time was just a ruse to get you to to sign the application" or something along those lines) I will report on this tomorrow, or when i finally get an answer that fulfills my question to it's full extent. I'm perfectly happy to get a gianormus paycheck but feel betrayed that my supervisor took advantage of a big retail time to change my schedule to something that it isn't nor could've ever been.

this really shows you how much this week helps Fry's, cause the cost of having every single Fry's employee work overtime in that week must count in the hundreds of thousands. (even i'll get overtime if my schedule isn't changed). on that note if it even cost them a noticable fraction of the total profit they wouldn't do it,(if you don't agree with me look at some of the rants from my fellow Fry's Associates) shows us how "valuable" their workers really are 'eh.

Sadly it is legal! It is unethical and immoral but so is business.

I am scheduled to work 4am - midnight and then comeback the next morning at 9am. I have two, half hour breaks scheduled at 1:30 pm and again at 4:00pm. I will be on my feet for over 9 hours without out a break!

I have worked retail on BF many times, I have never had to work the whole day with only two breaks.

Fry's should be ashamed of themsleves for making employees do that.

Who cares its once a year. At least you get all your overtime and doubletime. I know one thing for a fact, NONE of you will be bitching when you get that big check the following week.

People like you bring disgrace to American workers. Other countries have longer work days with no complaing. God forbid they force you guys to work a minute over your 8 hours and you go on your computer to rant about it.
If you didnt plan on doing this, dont get a job in retail and go elsewhere. Dont ask for a change, BE the change.
