    I am curious if you get the 5 day suspension, what is the right thing to do in order to try and receive unemployment? I know by now that a 5 day means your pretty much done with frys so do you just come back and have them try and force you to sign paper work or is there a slight possibility that you will just return to work? Does anyone have any knowledge on this ?

    I haven't been with the company more then a year but from everything I heard a 5 day was as good as you were fired. It sounded dumb but a not too long ago someone I heard of got 5 dayed and he's back now so who knows. What did you do?

    Just leave, it's no point. Especially if you are well deep in the draw.

    As SDCherryPicker said - DON'T - Do NOT sign anything. No employer an force you to sign a document that you voluntarily quit. You are essentially signing your rights away. If you're fired for cause, then you can be denied unemployment benefits. You have the right to appeal a denial of unemployment benefits, which entails going before an administrative law judge. and squaring off with your ex-employer.

    Yup, don't sign. That's how they save on unemployment insurance by getting you to sign a voluntary quit form.

    I didn't sign anything and I just got approved for unemployment after my phone interview. I got fired for the dumbest reason

    The five day suspension is not a voluntary quit notice, it clearly "should" state that this is a suspension for 5 days so that home office can review your file and once this is completed they call the SM and give a final decision. no one in the building can just up and fire you. It has to go through the motions.

    90 days? You might as well consider yourself fired/unemployed because no one is going suspend that long.

    Fry's doesn't have 90 day suspensions, and i've never seen anyone come back with a 5 day suspension for a job. The 5 day is so they can file the paperwork and have your final check ready since termination requires you to be paid within 24hrs of your last day. Also if your state is a work at will state, they can up and fire you at any time. Your not union, you have no protection. Your manager can fire you if they don't like your tie if they want to.

    So Aviator, what happened to you?  
     
    I just got a 5 Day too from the Store Manager... I knew immediately 5-Day meant termination but the SM acted like it wasn't and home office would decide. If they took away my badge then their intention is obvious.  
     
    I'm being discriminated because they decide to suspend me, yet do nothing to the other associate - just because he's been working there for years - who was actually the main cause of me being suspended.  
     
    I bet when I return after the 5-day, they are just going to hand me my last paycheck and sign some termination paper? or is there a possibility that home office would overturn the action?  
     
    I am not leaving without a fight. I plan to sue if I have to because there's a lot of things wrong with the company. Frys doesn't care about keeping the best sales people

    I came back from a 5-day once (didn't get so lucky the second time, but that was related to draw). I know it's very rare, but unless you're getting the boot for draw or you know you did something totally wrong and it's easily proven, I wouldn't say you're definitely going to lose your job. Write up something good for the comment/rebuttal section (in my case, I sat in the office and typed up a 3-pg. thing before I signed anything) and make sure that stuff gets attached. I don't know if that made a difference with mine, but anyone with some kind of brain (hard to believe with this company, I know) would have seen my SM's reason for the 5-day to be completely ridiculous and uncalled for anyways.

    I thought they were supposed to give some sort of termination paper or notice. The SM just handed me my last paycheck and that was it. Just a generic "home office terminated you" response, just as I expected. The SM could easily just fire me for no-show and give home office a different reason.

    I am still employed at frys. I just wanted info first in case something happened. Doesn't hurt to be prepared.

    I was given 4 days off in a row from work. Saturday, Sunday, Monday, and Tuesday. But then I work Wednesday-Sunday. My co-worker informed me that this is bad because it means it's a 5 day.     That's not a "5 Day". You would be called to the office first. You happened to have the last two days off in the pay week then the first 2 days of the next pay week off. Our week starts Monday to Sunday.I shit trains, Now what?

    I have a friend a frys. He got a 5 day due to draw. Not that much of a debt just continuos. He orginally started as a merchendsier. Then went into sales. His manager said he would talk to the home office to see if he can get my friend the job as a merchendiser back. IS there something to worry, should he start looking for a new job?

    Your "friend" is as good as fired. Start looking for a new job.
